Introduction
This Privacy Policy explains how PocketKit LLC ("PocketKit," "we," "us," or "our") collects, uses, and protects your information when you use our website, web application, and related services (collectively, the "Services"). PocketKit provides a mobile wallet loyalty platform for businesses to configure and manage digital loyalty programs. Your privacy is important to us, and we are committed to protecting your information through the practices described in this policy.
Information We Collect
We collect information that you provide to us when you create an account, configure your loyalty program, submit an inquiry, or communicate with our team, including your business name, contact name, email address, phone number, account credentials, billing information, and configuration details related to your service. We may also collect communications between you and our team, including emails and phone call notes, for onboarding, sales, and support purposes. In addition, we collect limited technical information automatically, such as IP address, browser type, device information, and usage data related to your interaction with our web application, for security, diagnostics, and performance improvement.
How We Use Your Information
We use the information we collect to provide, operate, and maintain the PocketKit platform; configure and manage your loyalty programs; process onboarding, billing, and account administration; communicate with you regarding sales inquiries, onboarding, support, and service updates; monitor and improve platform performance and reliability; and protect the security and integrity of the Services. We do not use your information for third-party advertising purposes.
Payments and Financial Information
PocketKit uses Stripe as its third-party payment processor to handle billing and subscription payments. When you provide payment information, such as credit card or bank details, this information is transmitted directly to Stripe and is not stored on PocketKit’s servers. Stripe processes your payment information in accordance with its own privacy and security practices. PocketKit receives only limited information necessary to manage your account, such as billing status, payment confirmations, and transaction identifiers.
Data Ownership and Processing
All data related to your business, loyalty programs, and customers remains your property. PocketKit acts as a service provider and data processor on behalf of its customers for the purpose of delivering the Services. Where PocketKit processes personal data on behalf of a customer, including data related to loyalty program participants, PocketKit does so solely in accordance with the customer’s instructions and applicable data protection laws. For partners, including POS providers and enterprise customers, PocketKit’s data processing obligations may be further governed by a separate Data Processing Agreement or contractual terms.
Data Storage and Security
Your account information and program data are stored on infrastructure operated by PocketKit and our trusted third-party hosting providers. To enable the operation of our Services, your data may be transmitted through third-party service providers that support hosting, communications, analytics, and payment processing. These transmissions are secured using industry-standard encryption and access controls. While no system can guarantee absolute security, we take reasonable administrative, technical, and physical measures to protect your information.
Data Sharing and Disclosure
We do not sell, rent, or share your data with third parties for marketing or advertising purposes. We may share your information with trusted third-party service providers solely to operate and support the Services, with payment processors to complete transactions, if required by law or in response to valid legal requests, to protect the rights, property, or safety of PocketKit, our customers, or others, or in connection with a business transaction such as a merger, acquisition, or asset sale.
Marketing and Communications
If you submit an inquiry, request a demo, or otherwise express interest in PocketKit, we may use your contact information to communicate with you by email or phone regarding our products, services, onboarding process, and related offerings. You may opt out of marketing communications at any time by following the unsubscribe instructions in our emails or by contacting us directly. We do not share your contact information with third parties for their marketing purposes.
Data Retention
We retain your information only for as long as necessary to provide the Services, comply with legal and accounting obligations, resolve disputes, and enforce our agreements. Upon termination of your account, we will delete or anonymize your data within a reasonable period unless retention is required by law.
Your Rights and Choices
You may access, update, or request deletion of your account information by contacting us or through your account settings where available. Where applicable under data protection laws, including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), you may have additional rights to access, correct, restrict, or request portability of your personal data, or to object to certain processing activities. We will honor such requests in accordance with applicable law.
